If you and your spouse are unable to agree to the terms of your divorce, then you will have to proceed in court with a contested divorce. A contested divorce is initiated by one spouse filing a Complaint for Divorce. The other spouse then has 20 days to file an Answer to the Complaint. Two to three months after these documents are filed, the court holds an initial hearing. If both spouses retain an attorney, then oftentimes, the attorneys communicate during this period of time to discuss any interim issues that may need to be addressed.
A contested divorce can take six to nine months to resolve and can be quite expensive, especially if it ends with a divorce trial.
